Privacy Notice for Talent

This Privacy Notice explains how Flexiple Tech Private Limited (“Flexiple”, “we”) collects, uses, shares and protects your personal data when you join Flexiple as talent (including a contractor, candidate or other professional in our network). It is referred to in the consent you give when you build your profile. Please read it before giving your consent. Any additional detail, including our retention schedule, is in our Privacy Policy.

1. Data Fiduciary and contact

Data Fiduciary: Flexiple Tech Private Limited, incorporated in India, registered office at House No 43, Floor 1st, Block – C, Mahendra Enclave, Adarsh Nagar, Delhi, North West Delhi – 110033, Delhi, India. Our affiliate Flexiple, Inc. (Delaware) supports international placements and operations.

2. Personal data we collect from you

We collect the following categories of personal data directly from you when you create or update your talent profile or apply for opportunities:

name, CV/resume, LinkedIn profile URL, profession, skills, qualifications, work and project history, portfolio links, certifications.
phone number, email address, city/location, availability, work preferences (remote/hybrid/onsite, etc.).
current and expected compensation, and any related details you choose to share.
assessment results, interview notes, call recordings and transcripts, role preferences, suitability and matching outputs.
identity, KYC and background-verification inputs.
bank account and other payment/tax information needed for payouts.
usage, device, log, approximate location, analytics and security data generated when you use our platform.

You should not include sensitive personal data in your CV, profile or messages unless it is necessary for the relevant opportunity.

3. Purposes for which we process your data

We process the above personal data only for the following specified purposes:

To create, maintain and update your talent profile and understand your skills, availability and preferences.
To match you with opportunities and propose your profile, CV and professional information to prospective and existing client companies for hiring decisions.
To contact you about your applications and carry out screening (including calls, WhatsApp, SMS, email and AI voice-agent calls, which may be recorded and transcribed).
To run assessments and technology-assisted matching to evaluate your suitability for roles.
Where an engagement proceeds, to verify your identity, run background/KYC checks, and manage contracts, payments, tax and compliance.
To detect and prevent fraud, keep the platform secure, comply with applicable laws, and enforce our rights.
To retain your profile for future matching and referrals until you delete it or withdraw your consent (subject to any legal retention obligations).

We process this data on the basis of your consent. Where the law allows processing without consent, we rely only on a legitimate use under Section 7 of the DPDP Act (for example, to meet legal, tax or accounting obligations).

4. Your rights and how to exercise them

Under the DPDP Act, you have the right to:

Ask for a summary of the personal data we hold about you and how we process it.
Request correction, completion, updating or erasure of your personal data.
Withdraw your consent for processing based on consent (this may limit our ability to maintain your profile or propose your profile to the clients).
Nominate another person to exercise your rights in case of your death or incapacity.
Raise a grievance with us and, if needed, make a complaint to the Data Protection Board of India.

To exercise these rights, email our Grievance Officer at grievance@flexiple.com or write to us at the address above. We will respond within the time required by law and in any event no later than ninety (90) days.

We share your personal data with:

Prospective and existing client companies (who act as independent Data Fiduciaries for their own hiring decisions).
Service providers for hosting, resume parsing, communications and AI voice-agent services, payments, analytics and security.
Background-verification and KYC partners, our affiliate Flexiple, Inc., our professional advisers, and authorities where required by law.

We do not sell your personal data.

Your data may be stored or processed on infrastructure outside India (for example, cloud servers in the EU or the US) and may be transferred to Flexiple, Inc., international clients and service providers, as permitted under the DPDP Act and with appropriate safeguards.

We retain your profile and CV until you delete them or withdraw consent. Any other data is kept only as long as needed for the purposes above or as required by law. Detailed retention periods are provided in our Privacy Policy.

6. Security, children and changes to this notice

We use reasonable technical and organisational safeguards (access controls, encryption in transit and at rest where appropriate, logging and contractual protections with service providers). If a breach affecting your data occurs, we will notify you and the Data Protection Board of India where required.

Flexiple is for users aged 18 years and over; we do not knowingly process children’s data.

If we change this notice in a way that requires fresh consent, we will obtain it before applying the change.

7. If you are outside India

If you are located outside India, your personal data is processed and stored in India (and may also be stored on infrastructure outside India as described above), and the DPDP Act governs our processing. Your local data-protection law (for example, the EU or UK GDPR) may also apply and give you additional rights, which we will honour where they apply. To exercise any such right, contact our Grievance Officer.
