Flexiple Tech Private Limited · Issued under Section 5 of the Digital Personal Data Protection Act, 2023 (“DPDP Act”)

This Privacy Notice explains how Flexiple Tech Private Limited (“Flexiple”, “we”) collects, uses, shares and protects personal data when you create an account on behalf of your company to hire or engage talent through Flexiple. It is referred to in the consent you give on the client sign-up page. Please read it before giving your consent. More details, including our retention schedule, is provided in our Privacy Policy.

1. Data Fiduciary and contact

Data Fiduciary: Flexiple Tech Private Limited, incorporated in India, registered office at House No 43, Floor 1st, Block – C, Mahendra Enclave, Adarsh Nagar, Delhi, North West Delhi – 110033, Delhi, India. Our affiliate Flexiple, Inc. (Delaware) supports international placements and operations.

2. Personal data we collect from you

We collect the following categories of personal data directly from you (and, where applicable, from your company) when you create or use a client account:

  • name, work email, phone number, designation, login credentials and profile settings.
  • company name, website, industry, size, location and business contact details.
  • role descriptions, preferred skills, budget range, timelines, hiring process details and preferences.
  • your communications with Flexiple and talent, platform usage, device, log, analytics and security data.
  • billing contact, invoicing details, tax information and payment details needed to process invoices and payments.

3. Purposes for which we process your data

We process the above personal data only for the following specified purposes:

  • To create, secure and manage your client account and verify your authority to act for your company.
  • To understand your hiring needs and propose suitable talent, including sharing your requirements with potential candidates.
  • To provide recruitment and HR-support services and related communications (including scheduling introductions, interviews and engagement discussions).
  • To provide customer support, prevent fraud, keep the platform secure, comply with applicable laws, and enforce our rights.
  • To meet legal, tax and accounting obligations.

We process this data on the basis of your consent and the information you provide. Where the law allows processing without consent, we rely only on a legitimate use under Section 7 of the DPDP Act (for example, to meet legal, tax or accounting obligations). The engagement itself is governed by a separate agreement with Flexiple.

4. Your rights and how to exercise them

Under the DPDP Act, you have the right to:

  • Ask for a summary of the personal data we hold about you and how we process it.
  • Request correction, completion, updating or erasure of your personal data.
  • Withdraw your consent for processing based on consent (this may limit our ability to maintain your account or provide services).
  • Nominate another person to exercise your rights in case of your death or incapacity.
  • Raise a grievance with us and, if needed, make a complaint to the Data Protection Board of India.

To exercise these rights, email our Grievance Officer at grievance@flexiple.com or write to us at the address above. We will respond within the time required by law and in any event no later than ninety (90) days.

5. Sharing, cross-border transfer and retention

We share your personal data with:

  • Our affiliate Flexiple, Inc. and our service providers for hosting, communications, analytics, CRM, security, billing and payments related purposes.
  • Talent, where needed to introduce an opportunity or manage an engagement (for example, sharing your name, company and role details with candidates you wish to engage).
  • Our professional advisers and authorities where required by law.

We do not sell your personal data.

Your data may be stored or processed on infrastructure outside India (for example, cloud servers in the EU or the US) and may be transferred to Flexiple, Inc. and service providers, as permitted under the DPDP Act and with appropriate safeguards.

We keep client account and hiring data while your account is active and for as long as needed to provide services, maintain business records, meet legal obligations and resolve disputes. Detailed retention periods are provided in our Privacy Policy.

6. Security, children and changes to this notice

We use reasonable technical and organisational safeguards (access controls, encryption in transit and at rest where appropriate, logging and contractual protections with service providers). If a breach affecting you occurs, we will notify you and the Data Protection Board of India where required.

Flexiple is for users aged 18 years and over; we do not knowingly process children’s data.

If we change this notice in a way that requires fresh consent, we will obtain it before applying the change.

7. Clients outside India

If your company is based outside India, the data you and your representatives provide is processed and stored in India (and may also be stored on infrastructure outside India as described above), and the DPDP Act governs our processing. Where your local law also applies (for example, the EU or UK GDPR, or the CCPA/CPRA), additional rights and any required cross-border transfer mechanisms (such as Standard Contractual Clauses or the UK International Data Transfer Agreement) are addressed in the Master Agreement between us, not in this notice or the sign-up flow.
